Privacy Policy

This Privacy Policy outlines how Overland Portugal (“we”, “us”, “our”) collects, uses, discloses, and safeguards your personal data when you visit our website, make a booking, or use the Overland Go mobile application (powered by Moonstride).

Overland Ireland Tours LTD operates headprojects57.sg-host.com, its associated digital platforms, and the Overland Go app. We are committed to protecting your privacy and handling all personal information in accordance with applicable data protection laws.

Please note that the Overland Go app is provided through Moonstride, a third-party platform. Moonstride maintains its own independent Privacy and Cookie Policy, which governs how they process personal data within their system. You can review Moonstride’s policy here: https://www.moonstride.com/privacy-and-cookie-policy/

Legal Basis for Processing Personal Data

We are required to identify the legal basis for processing your personal data. We rely on the following bases under applicable law:

  • Contractual Necessity: Where processing is necessary to perform a contract with you (e.g., to process your booking, take payments, or provide you with the services you have purchased).
  • Consent: Where you have given clear consent for us to process your personal data for a specific purpose (e.g., explicitly agreeing to background location tracking in the app, or opting in to marketing communications).
  • Legitimate Interest: Where processing is necessary for our legitimate interests or the legitimate interests of a third party, provided those interests are not overridden by your fundamental rights and interests (e.g., sending marketing communications to existing customers about similar products, or detecting fraud).
  • Legal Obligation: Where processing is necessary to comply with a legal or regulatory obligation (e.g., for accounting or tax purposes).

Website Visitors

Like most website operators, Overland Portugal collects non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Overland Portugal’s purpose in collecting non-personally identifying information is to better understand how Overland Portugal’s visitors use its website. From time to time, Overland Portugal may release non-personally identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

Overland Portugal also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged-in users and for users leaving comments on headprojects57.sg-host.com blogs/sites. Overland Portugal only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally identifying information as described below, except that commenter IP addresses and email addresses are visible and disclosed to the administrators of the blog/site where the comment was left.

Gathering of Personally-Identifying Information

Certain visitors to Overland Portugal’s websites choose to interact with Overland Portugal in ways that require Overland Portugal to gather personally identifying information. The amount and type of information that Overland Portugal gathers depends on the nature of the interaction. For example, we ask visitors who sign up at headprojects57.sg-host.com to provide a username and email address. Those who engage in transactions with Overland Portugal are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. The legal basis for processing this booking information is Contractual Necessity, as it is essential for securing your tour, communicating with suppliers (DMCs), and handling subsequent payments (e.g., taking the final balance 60 days prior).

In each case, Overland Portugal collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Overland Portugal. Overland Portugal does not disclose personally identifying information other than as described below. And visitors can always refuse to supply personally identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Marketing and Promotional Communications

If you are a registered user of an Overland Portugal website, or if you download our sales brochure, Overland Portugal may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Overland Portugal and our products.

Our legal basis for these communications is:

  • Consent: Where you download our sales brochure, you are providing consent to receive marketing emails from us, with a clear option to unsubscribe.
  • Legitimate Interest (Soft Opt-in): Where you are an existing customer, we may rely on legitimate interest to send you information about similar products or services.

If you send us a request (for example via email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.

Aggregated Statistics

Overland Portugal may collect statistics about the behavior of visitors to its websites. Overland Portugal may display this information publicly or provide it to others. However, Overland Portugal does not disclose personally identifying information other than as described below.

Protection and Disclosure of Certain Personally-Identifying Information

Overland Portugal discloses potentially personally identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on Overland Portugal’s behalf or to provide services available at Overland Portugal’s websites, and (ii) that have agreed not to disclose it to others. This includes sharing booking information with our Destination Management Companies (DMCs) and tour suppliers to secure your specific tour arrangements.

International Data Transfers and Safeguards

Some of those employees, contractors, and affiliated organizations (including third-party processors like Checkfront, Intercom, and some DMCs) may be located outside of your home country, including outside the European Economic Area (EEA). By using Overland Portugal’s websites, you consent to the transfer of such information to them. Where personal data is transferred outside of the EEA, we ensure that appropriate safeguards are in place, such as reliance on the EU-U.S. Data Privacy Framework (DPF) or the implementation of Standard Contractual Clauses (SCCs) approved by the European Commission, to protect your data.

Overland Portugal will not rent or sell potentially personally-identifying and personally identifying information to anyone. Other than to its employees, contractors, and affiliated organizations, as described above, Overland Portugal discloses potentially personally-identifying and personally identifying information only in response to a subpoena, court order, or other governmental requests, or when Overland Portugal believes in good faith that disclosure is reasonably necessary to protect the property or rights of Overland Portugal, third parties or the public at large. Overland Portugal takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally identifying information.

Data Retention

We retain your personal data only for as long as is necessary to fulfill the purposes for which we collected it, including for satisfying any legal, accounting, or reporting requirements. Due to the long-term nature of corporate and tax record-keeping requirements, and for the purpose of maintaining an active customer relationship, data is kept on file and its necessity is periodically reviewed.

You have the right to request the erasure of your personal data, which will be processed according to the rights section below, provided we are not legally obligated to retain it.

Location Data Usage (Overland Go App)

Our app collects and uses location data to support your self-drive tour experience. The legal basis for this is Explicit Consent. This helps tour organisers monitor your journey, provide timely assistance when needed, and assist with navigation.

This ensures organisers can provide seamless support without requiring you to keep the app open at all times. We obtain explicit consent within the app specifically for background location tracking, separate from general policy acceptance.

Permissions We Request

Our app requests the following Android permissions to enable the above functionality:

  • ACCESS_FINE_LOCATION: For precise real-time location tracking
  • ACCESS_BACKGROUND_LOCATION: To continue tracking during the journey even when the app is not in the foreground
  • FOREGROUND_SERVICE: To maintain an ongoing location service with minimal battery impact and full user awareness

Data Handling

We do not sell or share your location data with third parties. All data is securely transmitted and used only to improve the safety and quality of your tour experience.

Third-Party SDKs

This app may use third-party services (such as Google Maps SDK) that collect limited information under their own privacy policies. We recommend reviewing their policies for more details on how they handle data.
